Terms of sale

Conditions come into effect the 2018/12/01:

Article 1 : Field of application

These General Terms and Conditions of Sale (so-called “GTCS”) apply without restriction or reservation to any subscriptions of stay (said “Stay”) as proposed by the Provider, Novovento coworkation Azores, to the customer (said “Customer”) on the site https://www.novovento-coworkation.com.

Stays take place at the establishment named Novovento, located Lomba de Cima 13, 9555-081 Ginetes, São Miguel, Portugal (Alojamento Local licence n°2193/AL).

The Customer is required to read these Terms and Conditions before ordering. The choice and the purchase of a Stay are the sole responsibility of the Customer.

These Terms and Conditions are accessible at any time on the site https://www.novovento-coworkation.com and will prevail over any other document.

The Customer declares to have taken knowledge of the present GTCS and to have accepted them by checking the box provided for this purpose before the implementation of the online ordering procedure of the site https://www.novovento-coworkation.com.

Unless proven otherwise, the data recorded in the Provider’s computer system constitutes proof of all transactions concluded with the Client.

Article 2 : price

Stays are provided at the current rate on the site https://www.novovento-coworkation.com, at the registration of the order by the Provider.

The prices are expressed in euro.

The rates take into account possible reductions that would be granted by the Provider on the site https://www.novovento-coworkation.com.

These rates are firm and non-revisable during their period of validity but the Provider reserves the right, outside the validity period, to change the amount at any time.

An invoice is drawn up by the Provider and can be given to the Customer during his stay on the Novovento site if needed.

Article 3 : Orders

It is up to the Customer to select on the site https://www.novovento-coworkation.com the Stay that he wishes to order according to the following offers:

  • Solo: the Customer reserves a stay of a specific duration and provides the data of his credit card. The Provider verifies the availability of the requested accommodation and validates, if possible, his/her order. The Customer’s credit card is immediately debited from 50% of the total amount of the booked stay. The balance to be paid (50% of the total price) is debited on the day of arrival of the Customer.
    The Customer receives notifications by email of the validation of his order, for the debit of the account and the debit of the balance.
  • Team: the Customer gives the Provider the elements of the stay (duration, number of persons). The Provider sends him a purchase order. The Customer checks this purchase order.
    The order is confirmed by the payment by bank transfer of the total amount of the order at least 30 days before the beginning of the stay.
    The Customer receives notifications by email of the validation of his order and for the debit of the amount.
  • Life Design retreat: a retreat is composed of the two following services: the stay at Novovento and the Design sprint. The booking is validated by charging the total amount of the stay.
  • Special offers: the Customer’s credit card is immediately debited from 100% of the amount of the booked stay.

Article 4 : Payment conditions

The price of the Stay is paid by way of secure payment as follows :

  • Solo: payment by credit card. The payment data is exchanged in encrypted mode thanks to the protocol defined by the authorized payment service provider (Stripe) intervening for banking transactions carried out on the site https://www.novovento-coworkation.com.
  • Team: when ordering, payment of the amount is made by bank transfer.
  • Life Design retreat:
    • The stay at Novovento: payment by credit card, at least one month before the retreat.
    • The Design sprint: payment of the amount is made by bank transfer, directly to the Design sprint manager, at least one week before the retreat. After this date, the reservation is canceled if the payment has not be made.

Payments made by the Customer will be considered final only after effective receipt of the sums due by the Provider.

The Provider will not be required to proceed with the supply of the Stay ordered by the Customer if it does not pay the price in full under the conditions indicated above.

Article 5 : supply of services

The Provider can not be held responsible for connection ruptures caused by the internet access provider from which he has taken his subscription.

Article 6 : cancellation conditions

  • Solo: In case of cancellation, no refund of the deposit will be made.
    In case of force majeure, the Provider reserves the right to cancel the order placed by the Customer up to 72 hours before his stay. In this case, the sums paid by the Customer are fully refunded to him, with the exception of transport costs incurred (plane tickets) which are not reimbursed in any case.
  • Team:
    Without any payment 30 days before the beginning of the stay, the booking is cancelled.
    For any cancellation made at least 30 days before the beginning of the stay, the deposit will be fully reimbursed.
    For any cancellation made within 30 days before the beginning of the stay, no refund will be made.
    In case of force majeure, the Provider reserves the right to cancel the order placed by the Customer up to one week before the date of stay. In this case, the sums paid by the Customer are fully refunded to him, with the exception of transport costs incurred (plane tickets) which are not reimbursed in any case.
  • Life Design retreat:
    • The stay at Novovento: For any cancellation more than one month before the retreat, the amount is fully refunded, after deduction of application fees (15€). For any cancellation less than one month before the retreat, no amount paid is refunded.
    • The Design sprint: No refund is made concerning the payment of the sprint.
  • Special offers: No refund is made concerning the payment of special offers booking.

Article 7 :  IT and freedoms

The personal data requested from the Customer is necessary for the processing of his order and the preparation of invoices, in particular.

This data may be communicated to the Provider’s partners who are responsible for the execution, processing, management and payment of orders.

Article 8 : rules and regulations

During his stay, the Customer is required to comply with all laws and mesures applicable. He must not do anything that could interfere with other customers on the Novovento site : cause nuisance or neighborhood disturbances, be the cause of loss or damage, break into computer networks to which he must not access, steal or take personal data or hack.

Internal rules specifying the conditions of community living on the site of Novovento is available in the establishment.

Any damage to Novovento property at the accommodation by the Customer must be paid for at the price requested by the Provider.

The Provider reserves the right to refuse access to the space, cancel and refund remaining Customer at any time.

If the Customer arrives and decides to leave earlier than scheduled, in a case of a no-show or cancels the booking after the arrival date, full payment will be required.

Article 9 : Responsibility of the Provider

The Provider can not be held responsible for :

  • damage, loss or theft relating to the belongings of the Client
  • allergic disorders of the Client insofar as the Provider has not been informed in writing, in the form completed during the ordering procedure, of this allergy
  • physical injuries that may occur during trips organized by the Provider, particularly during transfers made by the Provider’s partners or by the Provider himself.
